Tough Toys products are warranted against defects in materials and workmanship for a period of twelve (12) months from the date of initial retail purchase. Tough Toys are obliged under this warranty and will repair, replace or credit where necessary, any part that has been found to be defective in its product.
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
If in the unlikely event that a Tough Toys product fails due to faulty manufacture, within 12 months from the date of the original purchase, Tough Toys will offer to replace the product at the customer’s cost.. Warranty claims are subject to evaluation based on use in accordance with the "Instructions for use" provided on the Tough Toys Website and/or in print form.
Tough Toys does not warrant or make any representations concerning its goods when:
Tough Toys will not be liable for labor charges and other intangible or consequential losses that might be claimed as a result of a failure of any Tough Toys component or part thereof to the extent permitted by Australian Law.
In addition to other rights and remedies of the consumer under Australian law, this warranty is provided with Tough Toys products.
If wear and tear, abuse, misuse, accidental impact/s or failure to follow the 'Instructions for use' is found to be the cause of failure of a Tough Toys product, this warranty will be considered void and Tough Toys will offer to replace the product at the customer’s cost.
If a Tough Toys product is found to have been modified or altered in any way, or the product/s, though damaged, is/are still intact, serviceable and capable of performing its/their intended function, and is/are not faulty, Tough Toys will offer to replace the product at the customer’s cost.
Please contact Tough Toys by completing the warranty claim form and explain the reason for the Warranty Claim. Provide images of the product/s in question if possible. The date of purchase and "Proof of purchase" is also required.
Re-pack the entire product/s ready for shipping and arrange for the product/s to be returned to Tough Toys. If the product is found by Tough Toys to be faulty, a replacement or refund (as applicable) will be arranged, normally within 7 working days of receipt of the product (this may take longer in some cases).
